Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee(s) were exposed to being caught between truck(s) operating in reverse gear and stationary objects: a) On or about October 28, 1985, a 1975 Ford refuse truck (License Number AJ9456) was operated in reverse gear in the vicinity of the intersection of Wilder Road and Oakwood Court while loader employees were riding on the rear steps. One feasibe and acceptable abatement method, among others, to correct this hazard is to develop and enforce rules and standardized procedures for all back-up operations whereby loader employees are not permitted to ride on steps while backing up and requiring the driver to have loader employees in clear view for signaling purposes.
