29 CFR 1926.200(h)(1): Accident prevention tags shall be used as a temporary means of warning employees of an existing hazard, such as defective tools, equipment, etc. They shall not be used in place of, or as a substitute for, accident prevention signs: Dusit Thani Hotel Jobsite, Sixth Floor, Banquet Room 1 and 2: Pacific Rim Land Development did not use accident prevention tags to warn employees of the hazards of the four tier fabricated frame orange mobile scaffold. On October 18, 2014, the mobile scaffold toppled over fatally injuring a plumber. The scaffold was hazardous in that the scaffold frame legs were not designed with holes to accept mobile scaffold wheel stem pins to prevent the wheels from coming out of the frame legs; and the height to base ratio of the mobile scaffold was greater than 4 to 1. When the orange scaffold toppled it was measured to be 16 feet, 7.5 inches tall and 4 feet wide.
