Section 5(a)(1) of the Occupational Safety and Health Act of 1970: On or about July 9, 1986 the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of fire and explosion due to the overfill and overflow of gasoline storage tank(s) which could result in burns, concussions, contusions, inhalation, coma, and death. This specific operation involved the transfer of gasoline from a barge, the "Princess B" docked at Pier 1E, into an on shore storage tank, #2138, located in #2 tank farm. One feasible and acceptable abatement method, among others to correct this hazard is: 1) (a) Provide full shift, on site, supervisory coverage during tank filling and transfer operation, and (b) Institute a program to ensure that all employees performing tank filling and transfer operations receive appropriate training for safe performance of the operations. 2) Institute a program in which tanks receiving transfer of Class 1 liquids from pipelines or marine vessels shall be: a) Caged at frequent intervals while receiving the transfer of produce and communications maintained with pipeline or marine personnel so that flow can be promptly shut down or diverted, and b) Equipped with an independent high level alarm located where personnel are on duty during the filling and transfer and can promptly arrange for flow stoppage or diversion, or equipped with a high level alarm system that will automatically shut down or divert flow.
