Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: the hazards of fire and explosion: On or about December 23, 1986, gasoline line tank No. 15 was allowed to overflow, creating a vapor cloud. The employer did not have an established procedure whereby employees were trained in the hazards of the chemicals they were measuring and in emergency action procedures in the event of an overfill situation. Among other methods, one feasible and acceptable abatement method to correct these hazards is to prepare a written emergency action plan, to train employees in the elements of this plan, and to monitor adherence to the plan. As a minimum, the necessary elements of this plan are: 1) Access the potential hazard of the product being measured or handled. 2) Train employees in the potential hazards of the product. 3) Determine and provide appropriate personal protective equipment for employees. 4) Ensure that on-site employees are made aware of the terminal operator's emergency signaling system, evacuation procedures and means of exit. 5) Train employees in all elements of this plan. 6) Periodically review the plan and report the training.
