Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of moving and shifting granulated sugar causing and employee to be trapped under the sugar: Establishment - sugar bin. Among other methods, one feasible and acceptable abatement method to correct this hazard is to develop and enforce a written confined space entry program. This program shall include, but is not limited to the following elements: 1) Specific procedures for the use of personal protective equipment, including a body harness with life line, 2) The provision for a trained observer adequately equipped to provide emergency assistance, 3) Testing of the confined space atmosphere for safe oxygen content and/or toxic agents, and 4) The development of an entry permit system.
