Abstract: On February 15, 2010, Employee #1 was installing tires at a tire store in Orange, CA. At least three coworkers were there as well: the store manager, a service manager, and another tire installer. The store manager and the service manager were considered supervisory personnel. Apparently, Employee #1 was struck by something, possibly in an arm, but there seems be a great deal of confusion about exactly what happened. He was taken by his family to the Harbor UCLA Medical Center on March 5, 2010, where he was treated and hospitalized. His left upper extremity was amputated due to necrotizing fasciitis, and he eventually deteriorated and experienced cardiac arrest at 4:50 p.m. on an unidentified daate. None of Employee #1's coworkers saw or heard that anything had happened to Employee #1 on March 4, which was the last day he was at work. Employee #1 had not reported any type of injuries to the store manager or service manager on February 15 or any day after that through March 4. The store manager learned of Employee #1's death when his aunt called on March 9, 2010. Employee #1 had been a part time permanent employee. A Cal/OSHA investigation found no evidence that any incident and injuries had occurred on February 15, 2010, or any other day through Employee #1's last day at work, March 4, 2010. It was determined that no standard, rule, order, or regulation set forth in Title 8 of the California Code of Regulations, was violated in connection with this incident.
