Abstract: On February 11, 2014, an employee was working as a construction laborer for a residential remodeling contractor. More specifically, he applied stucco and painted. He was working from an A-frame-type horizontal elevated scaffold, when he fell from a height of approximately 0.9 meters (3 feet). He sustained fractures to his left leg. He was transported to Harbor-UCLA Medical Center, and he was hospitalized for over 24 hours. The employer reported the incident to the Division of Occupational Safety and Health (DOSH) in a timely manner. The employee was interviewed on April 18, 2014. He stated that he was not aware of any problems with the scaffolding equipment. He further stated that the platform on which he had been standing measured approximately 1.5 meters (5 feet) in width. After an investigation of the incident that included but was not limited to the taking of witness statements, it could not be discerned from the record that the employer was in violation of a California Code of Regulations, Title 8 Safety Order with regard to the incident.
