Abstract: At approximately 8:45 a.m. on January 13, 2012, Employee #1, was climbing the stairs carrying a piece of plank to build a scaffold for drywall installation, when he tripped on a screw gun cord and fell down the stairs breaking his ankle and tibia. Before the accident, the injured employee was working in the stairwell doing drywall installation and scaffolding inside the stairwell. The evidence indicated that the screw gun had been used by the injured employee and his partner. The day of the accident was his first day on the worksite.
