Abstract: At approximately 2:40 p.m. on November 30, 2008, Employee #1, an employee of an employer in the business of decorating trees with lights during the holiday season, was wrapping lights around an oak tree in front of a shopping mall. Employee #1 used a ladder to climb to a branch on the oak tree. He got off the ladder and was standing on top of one large branch 10 feet 11 inches from the ground. His feet slipped. He grabbed the branch, hung for five seconds, and then fell. He broke his left ankle and left wrist and was hospitalized for three days. Employee #1 said he was planning to climb up the tree to wrap the tree with lights. He had no fall protection system. Other employees, including the Crew Chief, were working in the tree with ladders.
