Abstract: A coworker was using a backhoe, Case Model Number 580E, to remove earth from the perimeter of a house for the installation of a French drain at the house's footing. Employee #1 was using a hand shovel to "clean up" the excavation. The excavation was approximately two feet deep. The coworker exited the backhoe to ask Employee #1 if enough earth had been removed. The coworker then reentered the backhoe on the side not provided with steps or handrail. Employee #1 stood between the backhoe's bucket and boom and the exterior of the house. The coworker swiveled the seat to sit as he stepped over or around the controls for the front end loader and parking brake. Space between fender and the seat is approximately ten inches. Precise location of the seat is unknown. The coworker stated that he must have inadvertently actuated the backhoe's boom swing control. The coworker's left-to-right movement into the seat is consistent with the required action on the boom swing control needed to swing the boom left-to-right. The control was located on left side of the backhoe control console. Employee #1 was subsequently struck by the boom and bucket and pinned against the exterior of the house. Employee #1 was pronounced dead at the scene.
