Abstract: At approximately 10:00 a.m. on October 13, 2005, Employee #1, a superintendent, was working with an Arizona Department of Transportation inspector along the east side of the road I-10 that was closed to traffic. The employer, the Southern Arizona Paving and Construction Corporation was completing milling and paving activities on the northbound frontage road. Several other employees were working nearby, including an asphalt truck driver, who was backing up the frontage road toward a parked paver to dump a load of asphalt into the paver. Employee #1 and the inspector approached the road edge, at the time when the truck was about 20 ft away from them. The inspector stopped at the road edge and Employee #1 took two additional steps onto the road, directly behind the truck, which was backing up. Employee #1 stopped with his back turned to the truck. Moments later, the inspector saw, out of the corner of her eye, that the truck struck Employee #1 and ran over him with the two rear right hand tires. Employee #1 was killed.
