Abstract: On October 2, 2002, Employee #1, of Rustin Transportation Company, transported household waste to a landfill from a distribution center in a trailer called a tipper. He backed his trailer onto a hydraulic tipper and unhooked all the hydraulic hoses connecting the truck to the trailer. There is a trailer door release handle on each side of the rear of the trailer and this trailer release handle holds the tailgate in place. Employee #1disconnected the trailer door release handle on the passenger side but failed to unlatch the trailer door release handle on the driver's side. He backed the trailer onto the hydraulic tipper and raised the front of the trailer with the hydraulic tipper. The hydraulic tipper positions the trailer at approximately a 45- degree angle. After the trailer was raised, Employee #1 noticed that the garbage wasn't coming out, so he lowered the truck to a horizontal position. He noticed that the driver side-trailer door-release handle had not been released. At this point, all the weight of the garbage was pushing on the tailgate. The force of the waste pushed the tailgate, on the passenger side approximately a foot from the back of the truck. Employee #1 pulled the trailer door release handle towards himself to release the door. When the trailer door released, the spring tension caused by the forces created by the waste pushed on the tailgate. The trailer door release handle sprung towards Employee #1 striking him on the forehead. Employee #1 died from a concussion.
