Abstract: At approximately 11:25 p.m. on March 26, 2003, an employee working for an import/export company was unloading boxes from trailers at a loading dock. He was driving a forklift with a 1,500 lb. carton-clamp attachment, and deposited the boxes in a stack. At the time of the accident, he put the forklift in reverse, and at a high rate of speed, backed away from the stack while turning sharply. This action, combined with the fact that the clamp attachment was still extended in the full-vertical position caused the forklift to rollover. The employee was not wearing his seat belt and either jumped or was ejected from the forklift. The forklift fell on top of the employee, killing him. According to witness statements and a statement given by the employer, the employee had been reprimanded in the past for not wearing his seatbelt. The forklift involved was a Toyota Model 42 6FGCU18, Serial Number 67952.
