Abstract: At approximately 4:47 p.m. on April 9, 2002, Employee #1 was delivering a load of eggs on a pallet which was 48-in. by 40-in. also known as a four way, which means there were four layers of egg baskets. The pallet was holding a maximum of 48 baskets. A worker of the store was driving a forklift to unload the eggs. Employee #1 was walking next to the load towards the front of the truck. The forklift driver had placed the forks underneath the load and was moving back when the load became unstable. Employee #1 reached out to hold the load with both hands but he saw that the load was going to collapse and there was nothing he could do. The load fell to the side where he was standing and a little towards the front. Employee #1 jumped back and rolled hoping to get out of the way of the falling load. Employee #1 was struck by the load and could not get backup and experienced neck and back pain. Employee #1 was hospitalized with a fractured neck.
