Abstract: At approximately 10:35 a.m. on February 21, 2001, Employee #1, a general laborer, was digging a trench. He was not wearing a hard hat and was standing at the 4 foot trench. The foreman operating a backhoe truck struck Employee #1's head with the backhoe bucket. The foreman stated that he did not see Employee #1 and thought that he was three feet away from where he was digging. Employee #1 sustained trauma to the head and was taken to the hospital where he was treated for his injuries.
