Abstract: At 12:00 p.m. on June 5, 1999, Employee #1 suffered a serious injury on the tortilla machine at Arrietta Inc. The employer is engaged in operating the La Tolteca Mexican food restaurant. At the time of the accident, Employee #1 was greasing the sprockets and chain drive on the Ideal tortilla machine, Serial Number 00125495, Model TO -12000, while the machine was in its normal operation. Employee #1 had taken the cover or machine guard off the moving sprockets and chain drive. Employee #1 stated that after finishing the greasing job he went to check tortillas on the machine. He came back to put the cover back on the sprockets and chain. Employee #1 further stated that as he was walking close to the side of machine he slipped and fell on the floor and accidentally his right hand hit the moving sprockets and chain drive. His right hand got caught in the moving parts of the sprockets and chain drive which caused the amputation of his right middle and pinkie finger and the laceration of the rest of the fingers. At the time of the accident, the floor was slippery due to water on the floor. Employee #1 also stated that he was not instructed to turn off the machine before he removed the guard off the sprocket and chain drive. Employee #1 was hospitalized for treatment.
