Abstract: On January 18, 1999, Employee #1 was operating a forklift Number 893 to relocating product in a warehouse. While driving the vehicle down an aisle, he saw another forklift in front of him. He took his foot off the accelerator, which triggers the braking system, but the forklift did not stop. He collided with the other forklift. The force of the impact partially ejected him from the vehicle and into the other vehicle where he became pinned. He sustained multiple injuries in the accident including rectal laceration, and a broken pelvis. At the hospital, he underwent gastrointestinal surgery to repair the damages to his rectum through a colostomy procedure and orthopedic surgery to repair the damages to his broken pelvic bones. The daily forklift safety check chart for forklift Number 893 contained several notations of bad brakes prior to and after the accident. However, no action was taken to remove the forklift from service or repair it.
