Abstract: At about 12:45 p.m. on September 9, 1998, Employee #1, who worked for Hertz Equipment Rental in La Canada, California, sustained a serious injury while loading a truck crawler loader on a low flat bed trailer. On the day of the accident, Employee #1 arrived at the site about 11:30 a.m. to deliver a truck crawler loader and pick-up a defective truck loader, John Deere, Model 455G, Serial Number 79501. Employee #1 brought the defective truck loader to load it on a low flat bed trailer. The hydraulic oil was leaking from the truck loader. Employee #1 drove up to the middle of the flat bed and stopped the truck loader. When Employee #1 tried to move the truck loader to put it in a proper position, the truck loader took off and fell with Employee #1 from the flat bed to the ground. Employee #1 sustained head, back, and left leg injuries. He was hospitalized for two days. A cut on the left side of his head required 20 staples. Employee #1 stated that he had not received any training for the job he was doing at the time of accident.
