Abstract: The employer and Employee #1 were masking the windows on the west side of a building in an apartment complex in San Jose, California. Employee #1 was at the north end and the employer was at the south end. They were using extension ladders to reach the windows, standing on the rung approximately 5-to-6 feet above grade. A resident backed out of a carport approximately 30 feet behind Employee #1 to exit the parking lot. The vehicle came very close to the ladder of Employee #1 and he became startled, lost his grip and fell. The employer did not see the accident when it occurred. He only heard it and looked over after it had already happened. Employee #1 suffered multiple leg and hip injuries and was hospitalized.
