Abstract: On September 14, 2012, at approximately 4:00 p.m. Employee #1, a 55-year-old female Stevedore with Eagle Marine Services LTD. Was replacing a Thermo King Genset at the Employers storage facility located in San Pedro California. Employee #1 was working from a rolling ladder and was attempting to replace a nose-mount clip-on a Genset (container mounted refrigeration unit) at space number-twelve. Employee #1 had positioned a forklift with the forks partially raised to help support the replacement Genset, and while standing on the rolling ladder, Employee #1 removed the locking pins and the Genset (Thermo-King 05536H3474, Model SGCOS/Yanmar APLJ3461) struck Employee #1 knocking her to the ground. Employee #1 sustained multiple fractures to her left wrist and was hospitalized as a result of the event. Employee #1 was working alone at the time of the incident and it was later determined that the employer had failed to develop a two-man procedure that would allow someone to be at the controls of the forklift to safely support the Genset while being changed out. Eagle Marine Services LTD was a facility that receives and prepares for shipment maritime shipping containers coming in from overseas or destined to be shipped overseas from their dockside facility. Employee #1 was employed as a regular full-time stevedore.
