Abstract: At approximately 2:30 p.m. on March 13, 2007, Employee #1 was working for the Cherne Contracting Corporation, a general or special trade contractor primarily engaged in the construction of heavy projects. Starting that morning, three Cherne employees had placed approximately thirty-two I-beams about 8 feet up in a bay of a new unit under construction. None of the I-beams were secured, and they would not be clamped in place until their elevation was set precisely. Employee #1, who was not involved in the I-beam placement, entered the bay at approximately 2:30 p.m. during break time to run an extension cord through the bay and over a wood forming wall. As he stepped up on the cross bracing supporting the I-beams to reach over the wall, he lost his balance. He grabbed an I-beam to stabilize himself, but since the I-beam was not secured, it fell over onto his right leg. He sustained multiple fractures to his right leg, and he was hospitalized.
