Abstract: At approximately 7:00 a.m. on November 11, 2006, Employee #1 was the driver of a large truck. Employee #1 was delivering vegetables to the facility where he was injured. The delivery truck was not connected to a loading dock, but rather it was out on the street. An employee of the facility was operating a Class 4 forklift on the street and was lifting loads from the truck and driving the loads into the facility. Employee #1 was inside the truck using a pallet jack borrowed from the facility. When the necessary loads were removed from the truck, both Employee #1 and the facility employee began to remove the pallet jack from the truck by loading it onto the forks of the forklift. Employee #1 got on top of the pallet jack while it was on top of the forks of the forklift. As Employee #1 and the pallet jack were being moved, Employee #1 and the pallet jack fell over, and the pallet jack hit Employee #1. Employee #1 sustained a broken pelvis, broken shoulder, and three to four broken ribs and was hospitalized for nine nights.
