Abstract: On January 7, 2005, Employee #1 was sent by one company to another to pick up two oversized, foam-filled tire and wheel assemblies (tires), each weighing between 800 and 1,000 pounds. A fork lift operator at the pick up location was helping Employee #1 to load the tires into the trailer, using a forklift to retrieve each tire individually from a location behind a nearby building. After successful delivery of the first tire, the forklift operator secured the second tire by driving the forks of the forklifts through the center of the tire's wheel and bringing it to the trailer. Employee #1 saw that the tire was swinging on the forks as it approached his position in the trailer and he asked the forklift operator to "slow down". When the tire stopped moving, the forklift operator lifted it over the side rail and lowered the forks as before. However, Employee #1 reported that the deck of the trailer moved as though the forklift forks were pushing down on the rail. Nevertheless, the loading continued and the forks were pulled out from the wheel hub opening. As the forks pulled away from the side rail of the trailer, Employee #1 reported feeling the deck "bounce upward" just as the tire fell and hit the deck. Unexpectedly, the tire fell toward Employee #1, who was standing in the trailer, instead of falling toward the rail, as anticipated. The tire caused Employee #1 to fall to the deck of the trailer, and the tire fell on his right leg. Employee #1 sustained a fracture, and he was hospitalized.
