Abstract: On January 17, 2002, Employee #1, a painter, needed to paint a window frame that was on the second floor outside of a house under construction. A scaffold had been erected around the house that was going to be used by the stucco contractor and provided a more convenient way to paint the window. The foreman inspected the scaffold and declared that it met codes for planking, footing, attachment to the house, and construction in general. The scaffold collapsed, and Employee #1 fell 12 foot 4 inches to the ground, lacerating his head. Examination of the plank revealed that it was scaffold grade and that it had broken across the grain in approximately the middle of the plank. The inside of the plank was infested with dry wood termites that had compromised the structural integrity of it. On inspection after the break, some pinholes on the surface of the plank were observed. Although these could have been mistaken for old nail holes, they were in fact the only clue to the internal damage to the wood, and could easily be overlooked during inspection. Employee #1 was hospitalized to treat his lacerated head.
