Abstract: On September 6, 2007, an employee was driven in dump truck to the shopping mall parkway by the immediate supervisor. At that time, the Supervisor stated that he discussed and instructed the employee regarding the tree trimming procedures. The Tristania trees to be trimmed were young, thin branched and approximately twenty feet in height. The employee was instructed to use a pole trimmer and not to climb the trees. The Supervisor stated that as he drove away from the site he noticed the employee had started to trim a Tristania tree using the pole trimmer as directed. The supervisor drove the dump truck from an upper level parking area around a building and when he arrived at the site, found the employee sitting on the ground. The Supervisor stated that he was called within five minutes of leaving; to return to the site. Upon arriving, a coworker told the Supervisor that the employee told him that he had climbed the tree and tied off to a branch, the branch broke and he fell 11-ft to the ground. The employee suffered head, back trauma, and shoulder pain. He was hospitalized and was held for spinal precaution and observation.
