Abstract: On February 7, 2007, Employee #1 and 2 other employees were removing a 30 ft tall palm tree that was next to a 20 ft high commercial building. The tree trunk was about 32 in. away from the wall of a commercial building. There was a 16-ft high ledge on the building that was next to the tree. Employee #1 placed a ladder against the wall to access the tree and the ledge level. Employee #1 climbed the tree and trimmed off all the fronds using a chainsaw. The employee was equipped with a tree worker's saddle and a strap to wrap around the tree. In order to cut off a piece of the tree trunk, he balanced himself with one foot on the ledge and another against the tree trunk without tying himself to anything. As he cut away a 6 ft long piece of the trunk, it shook the rest of the tree as the piece of the tree trunk fell to the ground, causing Employee #1 to loose his footing. Employee #1 fell about 19.5 ft onto compacted dirt. The Division became aware of this accident on August 29, 2007, during a complaint investigation. Employee #1 suffered a head injury, laceration on his upper lip, a fracture to the lumbar, spine and tenderness in multiple parts of body including his back and both feet. Treatment included the repair of laceration on the employee's lip and pain management. Employee #1 was hospitalized for three days.
