Abstract: April 21, 2005, Employee #1 and a coworker were redecking an existing balcony. It was about 3 ft wide and 11 ft 11 in. above the concrete floor outside the house. This balcony ran along the side of the house, which included two semi-circular windows on the second floor. As part of the repairs and remodeling work, the top surface of the balcony was stripped. This balcony had the contoured edges to match the two semi-circular windows above it. Employee #1 was scribing a piece of plywood to make the contoured cut. He was standing on a deck, approximately 3-ft wide and accidentally stepped on a loose piece of 2 in. by 4 in. lumber. That caused him to loose his balance. As a result, he fell on a brick planter located 8 ft 8 in. below first hitting his head, and then he fell to the concrete floor 11 ft 11 in. below the balcony deck. Employee #1 sustained head trauma. He was determined to be brain dead. He was kept alive on life support for two days. He died as soon the life support was removed.
