Abstract: On August 29, 2003, Employee #1 was cutting a birch end piece for a Formica counter top using a Dado table saw. The table saw had a table top measuring 28.25-in. by 22.25-in. It had a plastic adjustable guard measuring 11-in. by 5-in. by 1.625-in. The guard was adjustable vertically and horizontally and flipped up and down. Employee #1 was performing a "blind cut dado" on a birch piece that measured 26 in. long and at one end 5.75 in high and 0.75 in. wide. No guard was used because the operation could not be done with the guard in place. Using the Dado saw to perform a blind cut dado was not routine and practice. The supervisor had never seen Employee #1 doing a blind cut dado. Employee #1 was using a push stick pushing the birch piece along the guide when for reasons unknown, it kicked back and the wood piece struck him on the head and left hand. When the piece struck Employee #1's hand, it caused him to jerk his hand into the saw blade amputating his left index finger down to the first knuckle. Employee #1 was hospitalized and treated for amputation.
