Abstract: At approximately 6:30 p.m. on November 18, 1997, Employee #1 attempted to clear a jam in a pistachio splitting machine. Employee #1 raised the guard with his left hand and with his right hand, pressed the micro-switch that normally would de-energize the machine with the guard open. The foreman taught Employee #1 this method because it is faster. Employee #1 then used a tool with his left hand to try to un-stick the pistachios. Employee #1 dropped the tool into the machine and reached down with his left fingers to catch the tool. Employee #1also released the micro-switch with his right hand. This allowed the machine to start running. Employee #1 sustained an amputation of the tip of his left index finger.
