Abstract: At approximately 1:12 p.m. on December 28, 2010, Employee #1 and Employee #2 removed drywall on the second floor of a construction site in San Diego, CA. Both employees worked next to each other on 8 ft. ladders, and stood on the fourth rung from the bottom making cuts into the drywall. The area being cut was approximately 4 ft. wide by 3 ft. high. Employee #2 warned Employee #1 that the cut drywall would swing out towards him. The cut piece of drywall swung off the wall and hit Employee #1's ladder. The ladder fell from underneath him. Employee #1 fell approximately 4 ft. to the ground and landed on his back. Employee #1 sustained an L1 compression fracture of the back. Employee #1 was taken to Sharp Memorial Hospital in Kearny Mesa by ambulance. Employee #1 spent three days in the hospital receiving several diagnosis (MRI and CATSCAN) and pain medication. Employee #1 was a full time demolition laborer. Cement Cutting, Inc. was a demolition contractor working in the San Diego County area.
