Abstract: At approximately 11 a.m. on September 15, 2004, Employee #1, a teaching assistant for a non-profit school for students with behavioral problems, was monitoring students. The students were engaged in a free play physical education exercise on their playground area, a blacktop parking lot located behind the school. Employee #1 and two other employees were monitoring and playing with approximately 10 to 11 students for a 40 minute play period. Employee #1 was playing with a student by rolling a hula hoop on the ground toward him and having him roll the hula hoop back. The student became agitated during the exercise and batted the hula hoop away. Employee #1 bent over to pick up the hula hoop and hand it back to the student. The student took a step forward and violently pushed Employee #1. Employee #1 fell backward, landed on her seat and struck her head on the asphalt. Employee #1 sustained a fractured skull and concussion. She was transported to Scripps Mercy Hospital, where she was hospitalized for five days.
