Abstract: On October 15, 2002, Employee #1 and other coworkers were painting a condominium complex in Carlsbad, Califonia. There was a driveway adjacent to the building that sloped down to an underground parking area. Employee #1 used a 24-foot aluminum extension ladder to access a deck on the building. The ladder leaned against the third level, which was about 16 feet above the grass. Employee #1 was on the second level deck, which was about 8 feet above the grass and used a short 4-foot aluminum ladder as a plank to reach the extension ladder. In the process of trying to get around to outside of the ladder, the 24-foot ladder slid and Employee #1 fell 18.5 feet to the side down to the concrete driveway. He fractured his back and spent three days in the hospital.
