Abstract: At approximately 3:23 p.m. on December 15, 2003, Employee #1 was working as a leadman with 15 years of experience in the trade. The equipment involved in the accident was Number 2 blender, no manufacturer or serial number was available. Employee #1 was cleaning and adjusting the brushes of the Number 2 blender. The Number 2 blender was divided into 2 sections, the machine mixer which mixes the different ingredients to form a flooring product and the brushes which are designed to pulverize chunks of cement. While standing on the mixer, Employee #1 asked a coworker to turn the power on to the brushes. The controls to energize the machine and the brushes were located on the East wall approximately 10 to 15 ft away from the mixer next to each other. The controls were labeled "M" for the machine mixer and "B" for brushes. The coworker activated the control to the mixer instead of the brushes. Employee #1's right foot was caught in the point of operation causing an open fracture. After the accident, emergency medical services were called, and they transported Employee #1 to Long Beach Memorial Hospital, where he was hospitalized and treated for a fracture.
