Abstract: A mixer truck had gotten stuck in a ditch so the jobsite foreman called Employee #1 to see if Employee #1 had a cable that the foreman could borrow. Employee #1 said, "Yes", he did have a cable that could be used to remove the mixer truck from the ditch. The foreman said he would go and get the cable from Employee #1. Employee #1 suggested that since he was in the area near to where the mixer truck had gotten stuck, he would bring the cable to the jobsite, which he did. When the foreman started the task, he parked the loader well in front of the mixer, with the bucket down. The foreman then made sure that everyone was out of the way before backing up. A coworker was on the left, driver's side, as a spotter, and Employee #1 and another coworker were on the right, passenger side. Everyone was at a safe distance away. The foreman began to back up the loader and unexpectedly and without notice or warning Employee #1 walked between the loader and the mixer truck with his back to the loader. Visual and verbal signals were given to the foreman to stop but he was not able to stop the loader from reversing. Employee #1 became pinned between the loader and the mixer truck. When the foreman saw the signals to stop he immediately changed the direction of travel and advanced the loader forward. The loader was then parked in a nearby place and the Emergency Response Technicians were called to the scene. Employee #1 was transported to the hospital with unspecified fractures and subsequently died approximately two weeks after the incident occurred.
