Abstract: On December 15, 2005, Employee #1 and a coworker were involved in the renovation of a five-story building, where a two-story theater was to be constructed. Employee #1 and his coworker were installing densglass sheeting on the outer wall of the north elevation of the building. Approximately 20 feet from the ground was a balcony where a five-level scaffold was erected and reached to the top of the building. Around the outside of the balcony cable railings were installed to serve as fall protection. The balcony was very narrow, only about 5-feet wide, causing the outer legs of the scaffold, as well as a ladder for roof access to touch the cable railings. While Employee #1 was on the roof of the building, his coworker, who was also the job foreman, instructed Employee #1 to come down and start installing the densglass sheeting at the balcony level. As Employee #1 descended the ladder, he lost his hand hold or footing and fell about 20 feet to the balcony and then fell another 20 feet from the balcony to the ground. Employee #1 was hospitalized and treated for a severe fracture to his right ankle, which required surgery.
