Abstract: Employee #1 had been employed as a full-time spotter for approximately 25 years for a large waste management company. Employee #1 and his coworker were sorting loads of trash from various trucks and bins. The coworker was driving a Caterpillar, Model Number 950F, Series II front-end loader. The site was a 57,600-square-foot transfer station, where various types of refuse were sorted it and loaded onto large trucks for transport to landfills. Employee #1's job was to control traffic in and around the transfer station and to spot trucks and other vehicles to dump locations inside the transfer station. The coworker's job was to take direction from Employee #1 and push refuse to the correct dump lane, while maintaining a 15-foot clearance from spotters or other pedestrians. At the time of the accident, Employee #1 and his coworker were working in the southeast corner of the transfer station. His coworker looked down and saw Employee #1 lying on the ground bleeding and writhing in pain. The coworker stopped the loader and alerted fellow employees of the accident. The coworker had run over Employee #1 with the loader. Employee #1 died from blunt force trauma to his legs and left arm on December 28, 2001.
