Abstract: At 10:15 a.m. on May 25, 2001, Employee #1 suffered a crushed right foot when a trash truck operated by a coworker ran over and then stopped on his right foot. Employee #1 has worked for the employer as a helper or swamper on a trash truck for approximately ten years. At the time of the accident, Employee #1 had just finished dumping a standard industrial trash bin using a 1984 Peterbuilt Front-Loading Collection Vehicle, California license number 5Y53230, Vehicle Number 64. The trash bin was located in the southwest corner of a parking lot which serviced a fast food restaurant. The truck entered the parking lot at the southeast corner going west. The truck stopped, Employee #1 got out of the truck, walked over to the trash bin enclosure, opened the gate and removed the bin. Employee #1 then pushed the bin in front of the truck and the coworker drove up, inserting the forks and dumped the load. Employee #1 waited for the bin to come down, the coworker backed the forks out and Employee #1 pushed the bin back into its enclosure and shut the gate. At this point, in order to make a right turn to have the truck facing north, the coworker began his ritual of driving back and forth, while turning to avoid backing into a block wall on the perimeter of the property and hitting the block wall enclosure holding the trash bin. At this time Employee #1 walked in front of the truck, which he thought had stopped, and was hit on the upper right side of his body by the truck and fell to the ground. As Employee #1 tried to get to his feet, the truck kept on going, running onto his right foot. Employee #1 screamed and the coworker stopped the truck and went to the passenger side of the vehicle to find out what was happening. When he reached Employee #1, he saw that he had stopped on the right foot of Employee #1. The coworker quickly returned to his vehicle and backed off the foot of Employee #1. The coworker then handed Employee #1 a cell phone and told Employee #1 to call the employer and inform them of the accident. A customer of the restaurant called the paramedics and Employee #1 never called his employer. Employee #1 was transported to Long Beach Memorial Hospital. Employee #1 spent 30 days in the hospital and had five surgeries, a skin graft, the total amputation of his small toe and partial amputation of his big toe.
