Abstract: At approximately 12:30 p.m. on January 8, 2010, Employee #1, a dietician aid, was pushing a food cart out of the kitchen after loading the cart with lunch food trays. The tray cart door opened for no specific reason. As Employee #1 attempted to close the food cart door while pushing the cart, Employee #1's right ring finger got caught between the cart door and frame of the cart, cutting/lacerating the right ring finger. Employee #1 was transported to U.S. HealthWorks Medical Group in Santa Clara, CA, where Employee #1 was treated for the injury. The employer was Mariner Healthcare, Inc., dba Skyline Healthcare Center located in San Jose, CA. and is engaged in skilled nursing care. Employee #1's fingers indicated no signs of amputation. High Hazard Compliance Unit-North arrived at the facility as part of programmed inspection and opened an accident investigation on May 7, 2012. This injury was misclassified and was not serious as defined by T8CCR 330(h).
