Abstract: At approximately 12:30 p.m. on June 9, 2005, Employee #1, an electrician, was working at a winery in American Canyon, south of Napa, CA. He was attempting to open the tailgate of a Ford pickup to load a toolbox into the bed of the truck. He was alone in the winery parking lot when he fell, striking the top of his head on the tine of the forklift he had placed behind the truck. Employee #1 could not recall details about the accident but he either fell 29 in. from the truck bumper or 33 in. from the truck bed. A coworker exiting the building saw him on the ground next to the truc, in a semiconscious state and with blood flowing from his head. The supervisor on site also came out and called an ambulance. Employee #1 was transported to Queen of the Valley Hospital. He suffered a scalp laceration and a depression of the skull, which required immediate surgery to repair. In subsequent interviews, Employee #1 did not clearly recall the circumstances but relayed that he felt that he had done nothing wrong or out of the ordinary. He also stated that there was nothing his employer could have done to prevent his injury. The weather and work surfaces were dry and clear. Employee #1 was experienced and trained in the tasks he had undertaken.
