Abstract: At approximately 11:30 a.m. on January 31, 1994, Employee #1, a handgun repairman, was test firing a .22 caliber semiautomatic pistol on which he had completed work. He had test fired 4 rounds of a 5-round clip when either a misfire or a malfunction occurred that jammed the gun. He tapped the loaded gun onto the side of the test fire snail. In the process, the gun slipped out of his right hand and fell to the concrete floor, 38 in. below the test fire port or bullet receptacle. The gun went off and a bullet struck Employee #1 in the face. He sustained injuries for which he was hospitalized for seven days. The employer was cited for a serious violation of T8CCR 3203(a)(7), for lack of training and instruction on the hazards unique to handling a misfired or jammed firearm. As part of the repair process, Employee #1 was required to test fire each repaired hand gun before it could be sent to the shipping department for mailing or returned to the customer.
