Abstract: Employee #1 had been hired by Marmolejo Contractors, Inc., and loaned to another employer as a casual laborer to work as a miner in a tunnel project. He was working underground with a crew of four employees of SKK, placing 100 ft of 6 in. steel discharge pipe on a rib approximately 7 ft above the invert of the tunnel. The employees had placed two 30 ft sections of pipe on the supports, but had not secured them before moving to raise the next section. As the crew was walking to the next section, the two 30 ft sections slipped off the supports. All five employees attempted to jump out of the way, but Employee #1's left foot was caught between the rear side railroad track and the length of 6 in. pipe. He severely fractured his ankle, requiring surgery and hospitalization. The employer failed to report the accident.
