Abstract: At about 3:00 p.m. on October 24, 1990, Employees #1 and #2 were installing concrete storm sewer pipe in a trench that was 75 ft long by 5 ft wide by 8 ft deep. They were in a 42 ft long section which had vertical walls and was not shored or shielded. A shield was on the site, but was not used because it would have necessitated removing a concrete curb located on the west side of the trench. A backhoe was at the south end with its back wheel on or near the curb and its outrigger on the spoil pile, which had been placed on the trench's west side. As Employee #1 was starting to get out of the trench, the curb collapsed and fell against him, pinning him to the east wall. Employee #2 was buried in a cavity created by the pipe. Employee #1 died within several minutes and Employee #2 received possible back injuries.
