Abstract: At 1:00 or 2:00 p.m. on May 19, 2020, an employee was working for a temporary staffing employment agency. She had been assigned to work as a janitorial employee at a firm that operated a warehouse. It handled apparel being imported through a nearby port. The employee was walking through the warehouse when she brushed her leg against a wooden pallet. She suffered a cut above her right ankle. Her supervisor was not in the immediate area at the time of the incident but came to her assistance soon after. The employee refused treatment. Then the injury became serious. On June 5, 2020, the employee was admitted to the hospital for cellulitis from the cut. She was hospitalized for three days. The workers' compensation manager of the temporary staffing employment agency. reported the incident to Cal/OSHA by telephone at 2:38 p.m. on June 6, 2020. The employer complied with the reporting requirements of T8CCR 342. Cal/OSHA began its investigation at 10:40 a.m. on June 23, 2020.
