Abstract: At 9:00 a.m. on September 5, 2019, an employee was in the process of cleaning a manhole as part of an overall operation to clear a worksite. A coworker was using an excavator to knock down trees. The employee heard the coworker idle down the excavator and assumed it was safe to approach within 75 feet of the tree felling operation. At the same time, the last tree the coworker knocked down struck a second tree that was 15 feet away from the employee. The second tree was knocked over and a branch struck the employee on the head. The employee received blunt force trauma that killed him.
