Abstract: At approximately 1:10 p.m. on January 3, 2019, Employee #1 was working as a scrap metal driver in the front yard area of a scrap metal recycling center. Employee #1 was in the process of closing the tailgate of the roll off container (Measurements: Roll Off Container L: ~261 inches, W: ~96 inches, H: ~80 inches) mounted to the Peterbilt Truck (Model # 567 VIN # 1NPCL70X5JD475848 Plate # P640951). During the process of closing the roll off container tailgate, the hinges holding the tailgate to the roll off container failed (broke off) resulting in the tailgate (Weight: ~730 pounds) falling on to the ground and striking Employee #1 on his pelvis area pinning him to the ground. The roll off container was purchased used from a previous recycling facility and had been used extensively and had exterior damage. Employee #1 sustained the following injuries: blunt force trauma of pelvis and later died from his injuries.
