Abstract: At 3:15 p.m. on September 18, 2017, Employee #1 was operating a Toyota HF-83 sit-down forklift at a recycling facility. The forklift was moving a metal bin container loaded with plastics. As Employee #1 began feeding the plastic recyclables into the bailer conveyor, he became pinned by the forklift. Employee #1 sustained injuries that resulted in hospitalization. The accident occurred on 09-18-2017 , at or about 15:15. The employer reported the serious injury to DOSH on 09-18-17, at 15:20 in compliance with the requirements of T8CCR �342. The DOSHs investigator arrived on site on 09-22-17 at or about 09:00. The injured was a full time permanent employee of the employer whose job title is a recycle worker who operates the forklift working at the Hesperia facility. Luis Zuniga was the injured employees supervisor and he was engaged in another task in another area of the yard. The injured employee was located next to the bailer/conveying system. The injured employee was engaged in the operation. Cesar Torres, was working towards the end of the shift. Just prior to the accident, Cesar was on a forklift and on his way to load plastics and bottles to the conveying belt - feeder (baler). He noticed that the belt was so slow causing the plastics on the belt to pile up and overflow from the fence of the belt. With the load in a raised position, he parked the forklift parallel to the south side of the belt conveyor (approximately 2-ft away) and dismounted from the forklift to adjust the speed of the belt. Shortly after he got on the ground, Cesar realized that he had left the gear in neutral, set the break but did not make sure that the control was out of the Drive mode. The forklift started to move towards the right and the back corner of the forklift turned towards him and pinned him against the side of the conveyor (the forklift continued to travel approximately 20 ft away in almost 180 degrees and stopped as it hit the bins. The followings are the factors that would have prevented the accident: When the operator dismounted the lift truck, the load engaging means should have been fully lowered along with controls set in neutral and brakes set to prevent movement. Cesar Torres sustained multiple fractures of ribs, clavicle and right foot. The employee was transported to Loma Linda University Medical Center where he was confined for more than 24 hours. The employer was cited serious accident related violation for �3650(t)(17). Forklift.
