Investigation Summary

On February 2, 2013, an employee was onsite assisting one of the employers forklift operators, at building "A", a metal structure closed on three sides with a roof. The front portion, east facing side had four garage door type openings; there were no doors. The structure housed a baler used to bale materials dumped by a bobcat or a forklift. On the day of the accident, the employee was on foot walking away from the scale located in the north portion of the yard at building "A"; he proceeded to walk south perpendicular to the entry path to the building garage door openings. The forklift operator he was assisting was stopped in front of the most south door opening. The employee stopped in front of the door opening just north of that door and was talking to the forklift operator he was assisting. The employee was facing south, the operator was facing north. At one point before the employee stopped to talk to operator, another forklift operator, entered the structure building "A" to dump materials at the baler at the opening where the employee had stopped. After making the drop, the second operator reversed the forklift to exit the structure. As the second operator exited the structure, he struck the employee knocking him to the ground. The employee sustained lacerations to his left leg. He was transported to Palomar Hospital, where he was hospitalized and treated for his injuries.
