Employee Fractures Leg in Fall from Step Stool

On March 26, 2012, Employee #1, an Assistant Manager, arrived at the Bank of America site at 8:00 a.m. to open the banking center. Bank of America is engaged in banking and financial services. They had thirteen employees working at the site and the workforce was not unionized. Employee #2 came in, and they began their morning tasks. Employee #2 started to process the night drop, and Employee #1 started to do some paperwork. Employee #1 wanted to hang some Easter decorations on the wall, so she brought out a metal step stool from the safe deposit area. Employee #1 placed the step stool in front of the two-drawer metal cabinet behind the teller line. Employee #1 climbed the step stool, and she just stepped on the metal cabinet from the second step of the step stool. She fell and landed on the floor. Employee #1 called out to Employee #2 for help, and Employee #2 called Emergency Services. Paramedics arrived shortly and Employee #1 was transported to Arcadia Methodist Hospital, where she underwent surgery. Employee #1 was diagnosed with a right knee fracture, and she was discharged on April 14, 2012. Cal/OSHA has determined that no Title 8 regulation was violated in connection with the accident.
