Employee's finger amputated in unguarded bench saw

At approximately 10:00 a.m. on January 21, 1993, Employee #1, a laborer, was using a Delta 10 in. portable bench saw to cut strips of foam insulation about 2 in. thick. The saw in use was only a few days old, and was not defective in any way. It had been, however, put into use without the enclosed blade guard, which was still in a plastic bag, along with the saw's miter gauge (the rip fence had been installed). Employee #1 slipped and fell toward the fully raised saw blade, amputating his right index finger about mid-digit. Employee #1 had not been trained in saw use and/or safety, but his foreman was working in the immediate vicinity.
