Employees Fall from Scaffolds

On March 16, 2005, Employee #1 and Employee #2 were hired to assist their employer in painting a three-story hotel building. Employee #1 and #2 were to mix paint, do caulking, cover windows, scraping, sanding and trenching at the base of the building. They were also told to do some of the painting on the lower level of the building, not from the scaffold. The Employer left for lunch and while away from the site, the two employees got onto the rolling scaffold and placed an 8-ft extension ladder on the scaffold. The two employees started painting on the front area of the building near the main entrance. The scaffold collapsed falling 20 to 25 feet to the ground. The accident resulted in Employee #1 being hospitalized with fractures to both ankles and surgery on his right foot. Employee #2 was hospitalized with ankle pain and swelling.
